WOW SHELVING LIMITED - TERMS AND CONDITIONS OF SALE
1. Application of These Terms and Conditions
These terms and conditions (“Conditions”) apply to every order placed by a customer (“you”) for the supply of goods by WOW SHELVING LIMITED (“WOW Shelving”, “we”, “our” or “us”), whether the order is placed online via our website (wowshelving.com), by phone, or through any other means.
By placing an order, you confirm your acceptance of these Conditions. Together with your order confirmation and any referenced documents or policies, these Conditions form the agreement (“Agreement”) between you and WOW Shelving.
2. Company Information
WOW SHELVING LIMITED is a company registered in England and Wales under company number 14269292. Our registered office is located at Wow Shelving Limited, Unit 71, Staunton Court Business Park, Ledbury Road, Staunton, Gloucestershire, GL19 3QS.
3. Service Availability
Accessing our website from jurisdictions where its content is unlawful is prohibited. If you access the website from outside the UK, you are responsible for compliance with local laws.
4. Customer Status
By placing an order, you confirm that you: (a) Are legally capable of entering into binding contracts; and (b) Are at least 18 years old.
5. Formation of Contract
5.1 Each order constitutes an offer to purchase goods in accordance with these Conditions.
5.2 Orders are subject to our acceptance, confirmed by an order confirmation email or by telephone.
5.3 A binding Agreement is formed upon our acceptance.
5.4 Please check your order confirmation carefully and contact us immediately if there are any issues.
5.5 You are responsible for ensuring the goods are suitable for your intended use.
6. Consumer Cancellation Rights
6.1 If you are a consumer, you may cancel your order within 14 days of receiving the goods.
6.2 To cancel, contact us in writing. Goods must be returned within 14 days of cancellation notice at your own cost, unless otherwise agreed.
6.3 Returned goods must be unused, in original packaging, and suitable for resale.
6.4 Refunds will be processed within 14 days of our receipt of returned goods, less any diminished value due to handling.
6.5 Bespoke, customised or made-to-order items (“Restricted Goods”) cannot be cancelled or returned unless faulty.
7. Delivery
7.1 Delivery is subject to stock availability. If we cannot fulfil your order, we will inform you and offer alternatives or a refund.
7.2 We deliver to Mainland UK addresses only. Additional charges may apply to remote or offshore locations.
7.3 Delivery dates are estimates and not guaranteed.
7.4 You must ensure accurate delivery details and availability to receive goods.
7.5 Delivery is kerbside only unless otherwise arranged. Pallet deliveries must be suitable for your premises.
8. Risk and Title
8.1 Risk passes to you upon delivery.
8.2 Ownership transfers upon full payment, including delivery charges.
8.3 Until payment is received, goods remain our property and must be stored safely and insured.
9. Pricing and Payment
9.1 Prices are as quoted at the time of order and may include VAT.
9.2 We reserve the right to correct pricing errors. Orders with pricing errors may be cancelled and refunded.
9.3 Payment must be made at the time of order unless a credit account has been agreed.
9.4 Credit accounts are subject to approval. Payment terms are 30 days from invoice. Late payments incur interest at 10% above the Bank of England base rate.
10. Returns and Refunds
Business Customers: 10.1 Report damages, shortages, or defects within 3 working days. 10.2 Voluntary returns are subject to our approval, a 30% restocking fee, and must be in original condition.
Consumers: 10.3 You have rights under the Consumer Rights Act 2015. If goods are defective, you are entitled to a repair, replacement, or refund, depending on the timing of the complaint.
11. Warranty
11.1 For business customers, warranties implied by law are excluded to the maximum extent permitted.
11.2 Where goods are found to be defective within 12 months, we may at our discretion repair, replace, or refund, provided the goods have not been misused or modified.
12. Liability
12.1 We are not liable for indirect or consequential losses.
12.2 Our total liability is limited to the price paid for the goods.
12.3 We do not limit liability for death, personal injury, fraud or any matter that cannot legally be excluded.
13. Intellectual Property
All intellectual property rights in our goods and related materials remain with us or our suppliers.
14. Data Protection
We use your data only to process orders and provide our services in accordance with UK data protection laws. For details, see our Privacy Policy at wowshelving.com/privacy.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control.
16. Governing Law and Jurisdiction
These Conditions are governed by English law. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer residing elsewhere in the UK.
